Supreme Court to decide on DACA by spring 2020

After months of public debate, the Supreme Court will decide on the Deferred Action for Childhood Arrivals or DACA program. According to the court’s schedule, the decision may come by spring 2020. DACA grants a two-year legal residency with the ability to work.

According to news reports, two legal questions will be weighed in the Supreme Court: Did the current administration violate the Administrative Procedure Act by failing to collect consultation and comments prior to ending DACA? And did the administration provide the true reason behind why it wants to end the program?

In an archived blog post, Karen Vanegas, a former intern at the White House Initiative on Educational Excellence for Hispanics, said that since 2012, more than 680,000 young people who were brought to the United States as children have received DACA. The majority of these applicants are of Hispanic origin.

“Research indicates that about 1.5 million undocumented youth in the U.S. are eligible for DACA and 400,000 more young people will be eligible in the coming years,” Vanegas wrote. “For me, receiving DACA was a life-changer, allowing me to reach my full potential.”

As of now, the Department of Homeland Security is renewing the applications of those who were already enrolled in the program –– more than 373,000 since 2017.

“We anticipate that the Court will likely issue its decision close to the end of June 2020, but it could come as early as January 2020 — and the exact timing is difficult to predict,” the National Immigration Law Center says.
